1. What is an industrial accident?

An industrial accident refers to injuries, illnesses, disabilities, or deaths of workers requiring more than 4 days of medical care due to work-related reasons. Industrial accidents are broadly categorized into accidents, illnesses, and commuting accidents.
However, injuries, illnesses, disabilities, or deaths caused by intentional self-harm, criminal acts by workers, or other causes are not recognized as industrial accidents.

2. Types of industrial accidents

Occupational accidents

Occupational accidents refer to incidents that occur unexpectedly, rapidly, or due to external influences (such as collisions, falls, electrocutions, etc.) in relation to work under the control and management of the employer. Examples include:
Accidents during work
Accidents due to defects in facilities, etc.
Accidents during events
Accidents during break times
Accidents in special locations
Accidents during recuperation
Accidents caused by third-party actions

 Occupational diseases

Occupational diseases refer to the following types of illnesses:
Cardiovascular diseases caused by work-related stress or exhaustion
Musculoskeletal diseases arising from tasks that strain the body
Diseases resulting from handling factors that can harm workers' health, such as chemicals, or exposure to them
Diseases caused by work-related injuries
Diseases caused by work-related mental stress, such as workplace harassment or verbal abuse from customers

Commuting accidents

To be eligible for compensation, commuting accidents must meet the following recognition criteria:
1.
The accident must occur during commuting.
Commuting refers to travel between home and the workplace related to employment, or travel from one workplace to another.
2.
The accident must occur while using the usual route and method of transportation.
The usual route and method refer to using public transportation, private vehicles, or walking (routes and methods recognized as commonly used by society).
3.
There should be no deviation or interruption in the route.
Deviating from or stopping the commute for personal reasons will not be recognized as a commuting accident.
However, accidents that occur due to actions necessary for daily life during the commute are eligible for workers' compensation.
What constitutes actions necessary for daily life?
a.
Purchasing daily necessities
b.
Participating in education or training at vocational training institutions that contribute to improving vocational skills
c.
Exercising suffrage or voting rights
d.
Escorting children or individuals with disabilities whom the worker is responsible for to childcare or educational institutions
e.
Receiving medical treatment at medical institutions or health centers for the purpose of disease treatment or prevention
f.
Caring for family members who require care at medical institutions or during recuperation
g.
Actions similar to those described in items 1 through 6 that the Minister of Employment and Labor deems necessary for daily life.
Even in cases where exceptions are recognized, only the accident during the commute is protected, not the entire process.
For commuting accidents, you need to submit the "Medical Care Benefit Application Form" and the "Commuting Accident Report Form.”

Harm to a child's health during pregnancy due to work-related reasons

If a pregnant worker's duties result in a work-related accident, commuting accident, or exposure to harmful agents, and as a result, the child born suffers injury, illness, disability, or death, they may receive treatment and compensation according to the Industrial Accident Compensation Insurance Act.

Impairment of mental health due to work-related stress.

If various mental stresses lead to the onset of mental illness, you can be eligible for recognition of work-related injury through a workers' compensation claim. In such cases, you may receive appropriate treatment and compensation as defined by the Workers' Compensation Act.
For example, anxiety disorders resulting from witnessing work-related accidents, workplace harassment or sexual violence, verbal abuse from customers, harassment from supervisors or colleagues, etc.

In case of being infected with COVID-19

If you contract COVID-19 by coming into contact with an infected individual while performing your duties, you may be eligible for recognition of a work-related injury through a workers' compensation claim. If recognized as a work-related injury, you may receive treatment and compensation accordingly.
