Refugee Status Determination Procedure - Interview

Important
The interview schedule will be notified in advance via telephone or a summon note by a refugee status determination officer.
A refugee status applicant is required to arrive at the specified location on the day and time given in advance with an identification card(Passport, Alien Registration Card).
The interview process may be recorded or taped. (Refugee applicants may request or refuse this.)

Things that are good to know during the interview

Applicant's rights at the time of interview

Where requested by a refugee applicant, a public official having the same gender as that of the refugee applicant can interview the refugee applicant.
The interview process may be videotaped or recorded. (Refugee claimants may request or refuse to do so)
To the extent that it does not interfere with the interview, you can request an attendance of a person who has a trust relationship (family, relatives, friends, public officials, etc.)
Refugee applicants may be assisted by a lawyer.

Application for the presence of a person with a trust relationship

Family, friends, lawyers, etc. can join the interview.
If you wish to be present, you must fill out the application form and apply in advance to the head of the local immigration and foreign government office.
If a refugee applicant applies for the presence, he/she must reveal the person's name, resident registration number (foreigner registration number, passport number if foreigner is not registered), gender and nationality.
The person to present must fill out and submit a confidentiality pledge prior to their attendance.
If the person who applied for the presence falls under the reason for the restriction of the seat, the presence is not available.

A limitation on the presence

A person who wishes to be present has violated Articles 7 and 11 of the Immigration Act in the past
A person who is expected to participate in an interview with a refugee applicant because an interview is scheduled by applying for refugee status for the same reason as the refugee applicant, and thus the fairness of the interview and examination may be hindered
A person with considerable grounds, such as suspected of providing false documents, etc. or instigating a refugee applicant to make a false statement, etc. in order to obtain refugee recognition
Precautions for the person to present

The person to present must not make any statements, such as answering questions from the refugee examiner on behalf of the refugee applicant or informing the refugee applicant of what to answer.
2.
A trusted person to present shall not engage in anything that interferes with the interview process of the refugee examiner or interferes with the fairness of the interview. If so, you may stop allowing the presence and be discharged from the interview room.

Interpretation

If the refugee applicant cannot express his or her intention in Korean, he or she can receive support from an interpreter.
If a refugee applicant requests it, a refugee interpreter of the same gender must translate it.

Confirmation of the refugee interview report.

After completing the refugee interview, refugee applicants can interpret or translate it into a language they can understand and check the contents.
Refugee applicants may request to view or copy the materials submitted by themselves and the refugee interview report.

Reading and copying materials, etc

Refugee applicants may request to view or copy the materials submitted by themselves and the refugee interview report. ※ Access or copy may be restricted if there is a clear reason to admit that there is a significant impediment to the fairness of the examination.
In this case, you must submit an application for reading / copying to the immigration official.
The application for reading / copying shall be made by clearly stating the materials to be read, etc., and when applying for copying, the application shall be made by designating the scope and number of copies. Fees for reading and copying 500 won per reading, 50 won per copy Location of reading materials, etc Data must be viewed only at the designated place, and data cannot be taken out. If immediate processing is not possible or if there is an unavoidable reason, such as a failure of the photocopier, the applicant may be allowed to read it on a fixed date or time or receive the copy.
Restrictions on Reading and Copying

If the work is disrupted by requests for too many copies that are not intended for the purpose or purpose of reading and copying data (in such cases, you can designate a time or divide it over a period of time to receive copies)

If too many copy requests interfere with your work, you can designate the timing of reading or divide it over a certain period of time to receive copies.

Where there is a clear reason to admit that there is a significant impediment to the fairness of the examination

❗️ The case part of the refugee status screening procedure may be omitted

Refugee applicants who fall under any of the following may have parts of the refugee recognition review process omitted (Refugee Act Article 8, Paragraph 5).
When applying for recognition of refugee status while concealing fact, such as submitting fabricated documents or making a false statement
When the applicant, whose refugee application has been denied or whose refugee status has been cancelled, applies for refugee status again without significant circumstantial changes
When a foreigner who has resided in the Republic of Korea for at least one year applies for refugee status on the verge of the expiration of the period of stay or a foreigner subject to expulsion applies for refugee status for the purpose of postponing the execution thereof
